Advertisement Policy for Research Analysts
The purpose of this policy is to ensure that Research Analysts (RAs) adhere to the advertisement code set forth by regulatory authorities, promoting transparency and protecting investors.
This policy applies to all forms of advertisements and communications made by Research Analysts that may influence investment decisions.
1. Compliance Requirements
- Research Analysts must ensure that all forms of communication, including pamphlets, brochures, notices, and electronic communications, comply with the advertisement code.
- Advertisements must accurately display the RA’s name as registered with SEBI, the registered office address, SEBI Registration Number, logo or brand name, and Corporate Identification Number (CIN) if applicable.
- All information in advertisements must be presented in a manner that is accurate, true, complete, and concise.
- A standard warning stating, “Investment in securities market are subject to market risks. Read all the related documents carefully before investing,” must be included in legible fonts.
- In audio-visual advertisements, the standard warning must be clearly visible and audible.
- If advertisements are issued in a language other than English, the standard warning must be accurately translated.
- In instances where SMS, messages, or pop-ups do not contain full details, a hyperlink to the official website must be provided, ensuring it contains all relevant information.
- When specific securities are quoted as examples, the disclaimer “The securities quoted are for illustration only and are not recommendatory” must be included.
- All advertisements and communications must state, “Registration granted by SEBI, membership of a SEBI recognized supervisory body (if any), and certification from NISM in no way guarantee performance of the intermediary or provide any assurance of returns to investors.”
2. Prohibitions
- Advertisements must not include any content that is prohibited by law, including false, misleading, biased, or deceptive statements.
- Misleading testimonials must not be included, and no advertisement should exploit the lack of knowledge or experience of investors.
- Advertisements must avoid exaggerated claims and superlative terms, such as “Best” or “No. 1”, unless these are substantiated by factual evidence.
- References to past performance are strictly prohibited, and the use of the SEBI logo in advertisements is not allowed.
3. Additional Compliance Requirements
- In the event of suspension by SEBI, the suspended RA is prohibited from issuing any advertisements during the suspension period.
- Research Analysts must refrain from engaging in promotional games, competitions, or schemes involving the distribution of prizes.
- A copy of all advertisements must be retained for a period of five years, in compliance with SEBI regulations.
4. Brand Name and Trade Name Usage
- RAs must prominently display their name, logo, registration number, complete address, and contact details on all platforms, including their website and advertisements.
- The names and contact information of the Compliance Officer and Grievance Officer must be included in all client communications.
- The disclaimer, “Registration granted by SEBI and certification from NISM in no way guarantee performance of the intermediary or provide any assurance of returns to investors,” must be displayed in all forms of correspondence with clients.
5. Effective Date
This policy became effective on 13 April 2026.
